Deadline to Submit WOTC Forms Approaching

Earlier this week, we reviewed the benefits and expansion of the Work Opportunity Tax Credit (WOTC) program.

Be advised that you must submit Form 8850 to your state Department of Labor no later than September 28, 2016 for WOTC-targeted employees hired before September 1, 2016.  The IRS’s transition relief that allows for extra time to submit Form 8850 will end Wednesday, September 28, 2016.  For all targeted workers hired from September 1, 2016 forward, the Form 8850 must be submitted to the Department of Labor within the normal 28 days after hire deadline.  Note that Form 8850 was updated in March to include the new targeted group of Long-Term Unemployment Recipients; please ensure you are using the latest forms, linked to below.

Submit IRS Form 8850, and required ETA Forms (9061, 9062 or 9175) to your state Department of Labor no later than September 28, 2016 for:

  • Long-Term Unemployment Recipient workers hired from January 1, 2016 through August 31, 2016; and
  • All other WOTC targeted group workers hired from January 1, 2015 through August 31, 2016
